I would like to check what’s new in this update and compare it to older version.

  • So far the most important change is in “Payment Terms” / Purchasing / Service fees are 5% of the purchase amount + $2 for purchases under $50.

(void $2 for purchases up to $40, 5% on purchases above $40 as of May 2018)

Is there ToS archive available to Fiverr Users? Does anybody know?

You can go to archive . org, it archives the TOS page but not the recent payments-terms-and-conditions page. Other than that there’s google cache.

This is interesting as although it is only a small fee increase this is going to disproportionatly affect the bottom of the barrel $5 gigs the most. And let’s be honest, $5 gigs dominate this marketplace.

Let’s say a buyer wants to purchase a $5 gig, they will now pay $7.25 - that’s nearly half as much again as the advertised service.

Will buyers put up with this? Will we see interest in $5 gigs decline over time? Will buyers instead opt for $10 gigs - just because they may as well if they’re going to pay a similar service fee? Is this Fiverr slowly trying to move away from $5 gigs in order to raise more revenue / drive profits going forward?

Interesting times…

Fiverr should closed this batch for charging sellers on buying anything in fiverr. All sellers should stood for each other and make a community to these issues resolves as already fiverr is charging us %20 on each $5.

Interesting point!

I understand that the world is in crisis and Fiverr needs to make money too, but this is not helping us sellers at all.

Fiverr has the right to change the ToS at any time. This includes raising prices. It doesn’t matter if you don’t like it: you’ve already agreed to it.

Of course. We’re just expressing our disagreement and I think we’re free to do so.

Though Fiverr is free to make changes in ToS at any time.

In my opinion, there should be such a decision on which both the parties can agree.

I guess we all know Fiverr can update their terms any time.

The small issue here is that fee changes deserve better communication than just updating the ToS in my opinion.

Fiverr could have said something like this a month ago. “Hey, we’re going to rise the fees starting November 2020, hurry up with purchases…”🙂

Didn’t this use to be in the ToS?

  • Orders are not eligible to be cancelled based on the quality of service/materials delivered by the Seller if the service was rendered as described in the Gig page. Buyers may rate their experience with the Seller on the order page, including the overall level of service quality received.

Unless it’s been moved to a different page, then this is a BIG change.

(Is this part new?)

Furthermore, Fiverr is not responsible for the content, quality or the level of service provided by the Sellers (even if they are Pro Sellers, Top Rated Sellers, offer Promoted Gigs or otherwise). We provide no warranty with respect to the Gigs, their delivery, any communications between Buyers and Sellers, and the Logo Designs created through the Logo Maker. We encourage users to take advantage of our rating system, our community and common sense in choosing appropriate services.

Oh, no… I have a feeling this isn’t going to end well. This paragraph was like the one thing we had against scammers and unreasonable people.

That additional section kinda, sorta, maybe a little bit covers the same thing, by transparently shifting the responsibility to the buyer.

It also somewhat closes a loophole: “if the service was rendered as described in the Gig page” technically excludes the order requirements page, and discussions in chat, and custom and/or non-default orders, which they might have lost money on in the past.

It also implies that no seller is exempt from responsibility, though it does eliminate Fiverr’s. I find it interesting that they explicitly specify the Logo Maker. And we know that logos are the top subcategory and gigs are ‘a dime a dozen’.

This is a part of Payment Terms chapter Order Cancellations now. There’s just a slight wording change.

I am not sure but I believe it is not new.

I have just made .pdf copies of both ToS and Payment Terms (Nov 2020) so that it’s easier to check differences in future updates.
