ozzieuk Posted April 6, 2013 Share Posted April 6, 2013 Flickr and YouTube Links are acceptable, However consider why your buyer chose not to allow you to use the image in the first instance, maybe they wanted to keep your delivery private.Also you might find this information useful:Ownership and limitations: unless clearly stated otherwise in the Gig description text, when the work is delivered, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the seller and the seller waives any and all moral rights therein. For removal of doubt, in custom created work (such as art work, design work, report generation etc.), the delivered service shall be the exclusive property of buyer. The seller expressly agrees to assign to buyer the copyright in any delivered services that do not meet the requirements of a work-for-hire under the U.S. Copyright Act. Additionally, independent of the U.S. Copyright Act, the seller agrees that unless he indicated otherwise in the Gig description, once the order is completed the seller assigns along with it to the buyer, to the fullest extent possible under the law, all of its rights, title and interest, if any, in and to the delivered service and waives any and all moral rights in connection therewith.So it is wise to err on the side of caution when considering the use of a customer delivery without their permission as once the order is delivered you have no rights over what you delivered unless you said to the contrary in the gig description and it it is clearly marked. Well, at least that’s my theory. Personally, when I order a voiceover, video, or graphic to promote my business, I like when sellers add it to their live portfolio.
