Hi,

 

I'm new to Fiverr and just finished creating my first gig. I have a few questions about a rule I encountered.

 

When I was setting up my new ad, I received a warning that I couldn't hire other freelancers on Fiverr.

  1. Does this mean I can’t hire, for example, a graphic designer to create images for my ad?
  2. I was also considering adding an artistic representation of my genealogy research to my premium package. Can I hire a freelancer to handle that for me since I’m not a graphic designer and the add was not on that area?

There's nothing wrong with that. I am a graphic designer as well and I've seen several other freelancers offer these services on the platform.

If you mean outsourcing part of the work on an order you'll receive (if the buyer orders the premium package), this is what Fiverr's help says:

Other freelancers’ work can be used in your delivery when you have the rights to use it, and it’s used as an element of your own delivery. 

It cannot be used as your own delivery when you are reselling it “as is” with no significant added value or transformative use, under the misconception that it is your original work—and in order to gain profit from price differences. That is called profit arbitrage and it is not permitted on Fiverr.

Examples of other freelancers’ work that you can use (if you have the rights to reuse it)

  • Designs as backgrounds for music videos

  • Images for websites or presentations

  • Music beds for explainer videos

It sounds like my plan is feasible. I’m planning to research the necessary information, gather historical documents, and later share a summary with a designer, who will create an image based on my findings.

I don’t intend to alter the designer’s work, aside from possibly adding a logo (still in development) alongside theirs if they use one. The final delivery will include this image along with several related documents and a list of relevant individuals.

Do you think this approach sound's legally?

Regarding copyright, I understand it’s essential to address this with the designer. Are there any specific aspects I should consider when negotiating copyright terms?

Maybe. You could check with customer support to get Fiverr staff's answer, eg. by creating a support ticket at: https://www.fiverr.com/support_tickets

It might be best mentioning something about the outsourcing in the gig, if you'd be sending the info about the buyer to designer.

You could just let them know what you intend to do with the designs and have them agree to that or for them to put that wording in the custom offer. eg. that you will need to be able to resell the content and need the commercial use option. If they don't mention extras for commercial use on the gig then you should have the rights anyway though  (you can check what it says in the Fiverr terms of service about copyright). Outsourcing can be an issue with some sellers if the buyer needs revisions though (eg. if the seller doesn't want it sent to your buyer until their order is complete).

I thought some genealogy software had options to easily create images with the info entered into it, of family tree stuff and different types of charts maybe. So with some genealogy software you might not need the designer to create the images.
