I think after 3 warnings for breaking the Fiver TOS Fiverr may do this on your behalf!

Go to the Fiverr support team. Explain what you have done yet. If there is any misunderstanding they will help you. But if you break TOS more than 3 times then it is likely that they will ban or delete your account.
