My seller copied the work he sold me from another person

I bought a service form this computer programmer on fiverr and I just looked up the assignment he did for me to see how other people did it and the first link is the exact same assignment he sent me. How should I go about this? Do I confront him or ask for a refund or both

Is it a school or university assignment? 
 

selling and buying those services are against fiverr TOS 

anyway you should report that seller to fiverr CS for plagiarism with links where he took it from and ask for a refund. 
Keep in mind that if you bought prohibited service your account also might get a warning or be terminated
