idostuff74
"Unless clearly stated otherwise on the seller’s Gig page/description, when the work is delivered, and subject to payment, the buyer is granted all intellectual property rights [and so on]"Can I also “clearly state otherwise” in an offer I send? The case in point being that I might want to make sure I get credited.
eoinfinnegan
In the case of Custom Offers, whatever you write there is considered to be the “Gig Description” so if you include it there then that should cover you.I always hated that part of the ToS as there is no provision for what happens should a seller decide to change their gig description. For example, if you were to change your gig description to include “the seller retains all intellectual property rights”, what happens to all of your previous clients who bought when it did not say it? How can they prove it?
homeestates
You can clearly state otherwise. Just state word by word what you want the situation to be. If you state that the work can only be used with you credited, then that is what should happen. You may have to point this out to buyers, though.
